COMPANY TITLE OWNERSHIP

HLH were, and still are, at the forefront of re-establishing Company Title as a means of dividing ownership rights to property.

HLH are highly experienced in Company Title transactions and have been involved in some landmark court decisions in the Land & Environment Court to determine whether or not Council approval is necessary for Company Title ownership.

Were were instrumental in negotiating a change to the Duties Act to avoid an anomaly in respect of certain company title transactions and we continue to be actively involved with, and make representations to, the Office of State Revenue and the law makers of the State to ensure that Company Title is a viable and legitimate form of property ownership.

Over the years HLH developed, and continues to modify, the HLH constitution for Company Title which enables our Constitution to apply to a wide variety of situations (see out dedicated website on Company Title).  Our Constitution is accepted by a number of leading financial institutions.

HLH have also assisted older style Company Title buildings in bringing them into the 21st Century.  By preparing a more suitable Company Constitution (formerly Memorandum and Articles of Association) that remove many of the obsolete restrictions of the earlier Company Title buildings.

HLH also advise on the stamp duty issues as well as CGT and GST implications on conversion of old company title structures to strata title or community title.

Finally, we have prepared a Company Title Contract that surpasses the older style Company Title Contract.  No more do Contracts (or at least HLH’s Contract) contain unworkable conditions that make no sense and scare away buyers – we have streamlined our Contract to simplify the whole process of purchasing or selling a Company Title property.
